USA POWER & LIGHT OPTIONAL “PREMIER

 SERVICE & MAINTENANCE WARRANTY AGREEMENT”

 

USA Power & Light, Inc. (USAP&L) warrants that, from the original installation/commissioning date, its generators sets will be free from defects in material and workmanship for the items and period set forth below. USAP&L will, at its option, repair, or replace any part which, upon examination, inspection, and testing by USAP&L or an Authorized Warranty Service Dealer is found to be defective. This optional “Premier Service & Maintenance Warranty Agreement” applies only to USAP&L emergency automatic standby generators sold and rated for use in "Standby" applications.

Two (2) Years.

- Service Supplies (As Required)

Two (2) Years.

- Lab Analysis (As Required)

Two (2) Years.

- Remote Monitoring 24/7

Two (2) Years.

 

THIS WARRANTY SHALL NOT APPLY TO THE FOLLOWING:

 

§         Repairs or diagnostics performed by individuals other than USAP&L and/or OEM authorized dealers, not authorized in writing, by USAP&L.

§         Any USAP&L generators used as rental or trailer mounted applications.

§         Failures caused by any contaminated fuels, oils, coolants supplied by others.

§         Failures due, but not limited, to observe any warnings, misapplication, overloading, normal wear and tear,  accident, misuse, abuse or negligence.

§         Failures due, but not limited, to any engine or component that has been modified or altered, installed, commissioned, operated, maintained, serviced, or stored otherwise than in accordance with, the manufacturer’s recommendations and instructions.

§         Damage related to insect infestation and/or caused by birds, rodents, or animals.

§         Failures caused directly or indirectly by malfunction of utilities (telephone, gas, power, or water) lines or equipment.

§         Failures caused by any external cause, impossibility, or act of God.

§         Any incidental, consequential or indirect damages of any kind including but not limited to: labor costs, installation costs, transportation charges, customs duties, etc., associated with the replacement or repair of defective parts or equipment failure, caused by defects in materials or workmanship, or any delay in repair or replacement of the defective part(s).

§         Telephone, cellular phone, facsimile, internet access or other communication expenses.

§         Expenses related to "customer instruction", investigative costs or troubleshooting where no manufacturing defect is found.

§         Costs incurred for equipment used for removal and/or reinstallation of generator, (i.e.; cranes, hoists, lifts, etc.)

§         Rental equipment used while warranty repairs are being performed.

§         Overnight freight costs for replacement part(s).

§         Overtime labor.

 

THIS WARRANTY IS IN PLACE OF ALL OTHER WARRANTIES, WRITTEN OR ORAL, EXPRESSED, IMPLIED OR STATUTORY. SPECIFICALLY, USAP&L MAKES NO OTHER WARRANTIES AS TO THE MERCHANTABILITY, FITNESS, OR SPECIFIC PERFORMANCE FOR A PARTICULAR PURPOSE. USAP&L ONLY LIABILITY SHALL BE THE REPAIR OR REPLACEMENT OF PART(S) AS STATED ABOVE. IN NO EVENT AND WITHOUT LIMITATIONS, SHALL USAP&L BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.
